1. Promotion Details, Concept and Participation

The Maaza Super Singer Promotion (“Promotion”) is a consumer promotion launched by Coca-Cola India Private Limited (“CCIPL”) wherein the individuals will get an opportunity to win below mentioned prizes by playing “Maaza Game” on www.coke2home.com/maaza in accordance with the terms and conditions mentioned herein:

  • Ticket to watch the Super Singer Finale Live (“Grand Prize”);
  • Four (4) bottles of Maaza of net quantity 600 ml and one (1) Maaza branded pen drive. (“Maaza Gift Hamper”)

It is hereby clarified that the Grand Prize and Maaza Gift Hamper shall collectively be known as Prize/Prizes.

The Participant may participate in the Promotion multiple times in accordance with the terms and conditions, but he/she shall be eligible to win the Prize only once under the Promotion.

The Promotion shall be valid only for the individuals residing in the state of Tamil Nadu (“Promotion Territory”).

Participation in the Promotion is subject to qualifying the eligibility criteria as laid under these Promotion terms and conditions.

Individuals interested in participating in the Promotion are invited to purchase the PET bottle of Maaza of net quantity 600 ml/1.2L/1.5L (“Promotion Product”) and find the (12) digit Maaza code visible through the transparent window on the label, once the bottle is empty. (“Maaza Code”)

The following number of Digital Coins can be earned through various net quantities of the Promotion Product:

  • 600 ml  :  1 Digital Coin
  • 1.2 L      :  2 Digital Coins
  • 1.5 L      :  3 Digital Coins

Count of Digital Coins represent the number of times the Participant can play the Maaza Game through one Maaza Code.

Game Entry Procedure – First Time Participants

  1. The Participant must visit www.coke2home.com/maaza and login using his/her mobile number. Such a Participant will then be required to mark his/her consent to the privacy policy, terms and conditions and thereby click on “Get OTP” tab in order to receive an OTP on his/her registered mobile number.

    The Participant will also be able to see an Info icon on the screen enabling him/her to learn more about the game.
  2. On successful completion of Step 1, the Participant must enter the OTP as received on the registered mobile number and click submit tab. (Step 2)
  3. On successful completion of Step 2, the Participant will be required to fill other necessary information for signing up, namely his/her Name , Email, Date of Birth, and click on submit tab. (Step 3)
  4. On successful completion of Step 3, the Participant will have access to multiple options on the introduction screen namely:
    • Play Game
    • Post signing up for the first time, the Participant will be eligible to play the Maaza Game for free i.e without the Maaza Code. (“Free Game”)

      It is hereby clarified that the Participant through one registered mobile number will be eligible to play the Free Game only once during the entire term of the Promotion.
      Score of the Free Game will get added to the Leaderboard.

    • Except for one Free Game, the Participant will be able to play the Maaza Game only through the Maaza Code.
    • Practice Game
    • The Participant can practice playing the Maaza Game through this option.
    • Scores of the Practice Game shall not be considered for the purpose of Prize under the Promotion and will not be added to the Leaderboard.
    • Practice Game will not have any MCQ (defined under clause 7(iv)).
    • How to Play
    • The Participant can learn about the game concept through this option.
    • Leaderboard
    • A leaderboard shall be created under the Promotion displaying the following:
      • Highest Score of the current week;
      • Participant’s current session score and his/her current rank in the Maaza Game;
      • Participant’s personal best score of the week.
    • The Leaderboard shall also display the share icon through which the Participant can share his/her score across Facebook, Twitter and WhatsApp (“Social Media Accounts”) for an opportunity to play the Maaza Game again by getting a bonus coin.
      It is hereby clarified that a fresh leaderboard shall be created each week under the Promotion and no scores of the previous week shall be carried forward to the next week.

  5. Digital Coins and Bonus Coins earned by the Participant.

    Apart from the Free Game, Maaza Game can be played only through Digital Coins and Bonus Coins earned in accordance with Clause 7 (xiv) of the Terms.
    Game Entry Procedure – Returning Participants

    • The Participant must visit www.coke2home.com/maaza and attempt to login using his/her registered mobile number. An SMS with an OTP is sent to such a Participant.

      “Dear User, welcome to your mango delight! Your One Time Password to get access to our exclusive game is xxxxxx”

    • Once the Participant receives and inputs the OTP, the Participant gets an access to multiple options on the introduction screen and the same procedure as applicable on the first time Participant shall apply.
  6. Stock without the Promotion offer will also be available in the Promotion Territory. Further, certain stock containing the Promotion offer may continue to be available even after the Promotion Period. However, consumers understand and agree that they will not be permitted to participate in the Promotion after the expiration of the Promotion Period and further, agree not to raise any claim or complaint against CCIPL or its agents in this respect.

    The Promotion is advertised and promoted, inter alia, through media including radio, digital media, point of sale materials, outdoor publicity through banners , posters, billboards, public announcements, website and other available media.

    The Promotion is subject to all applicable central, state and local laws and regulations.

    These Promotion terms and conditions (“Terms”) will be hosted at www.coke2home.com/maaza (“Promotion Website”).

2. CCIPL and Partners

This Promotion is sponsored by CCIPL, having its corporate office at 16th floor, One Horizon Center, Golf Course Road, DFL Phase V, Sector 43, Gurgaon- 122002.

A reputed travel agency, determined by CCIPL at its sole and absolute discretion (“Travel Agency”), shall manage all travel related logistics of the Promotion, including but not limited to making airline/train/bus reservations and hotel bookings and making other related arrangements.

This Promotion is administered by Interactive Avenues Private Limited (“IA”) which shall conceptualize the SMS/IVR for the Promotion Period, provide its technology platforms to CCIPL, including servers, bandwidth and other infrastructure including logistics as required.

3. Deemed acceptance of terms and conditions

Entry and participation in this Promotion will be deemed as an unconditional and an unequivocal acceptance of these Terms, including any modifications, revisions and amendments thereto. The decisions of CCIPL and/or IA shall be final and binding on the Participants in all matters related to the Promotion. Further, the Participants recognize that these Terms may be modified by CCIPL from time to time without any prior/public notice by posting the applicable terms and conditions on the Promotion Website. CCIPL also reserves the right to cancel or terminate the Promotion at any stage without assigning any reasons whatsoever. Successfully entering the Promotion and winning a Prize is subject to all requirements set forth herein.

4. Promotion Period

This Promotion will commence at 00:00:01 am Indian Standard Time (“IST”) on     July 1, 2019 (“Start Date”) and will continue until September 30, 2019 11:59:59 pm IST (“End Date”). The entries shall be accepted until the End Date. (The Period between the Start Date and End Date shall be called the (“Promotion Period”).

The valid timings for performing the prescribed procedure under these Terms for the Promotion are between 12:00:00 am and 11:59:59 pm each day of the Promotion Period (“Promotion Timings”).

5. Eligibility

Subject to the criteria of Promotion Territory, entry and participation in this Promotion is open to individuals who satisfy each of the following criteria (“Eligible Persons”):

  • must have attained eighteen (18) years of age.
  • own a valid cellular GSM or CDMA phone connection that is accessible at all times;
  • bear a good moral character and have not been implicated or named in any legal proceedings (either civil or criminal).
  • are not management, employees, directors or contractors, or the family of the management, employees, directors or contractors of CCIPL or IA, their related entities or other agencies, firms or companies associated with or related to the Promotion (including suppliers of Prizes).

Please note that any application received from states other than the Promotion Territory shall be declared as null and void and shall not be taken into consideration for determining the Winners of the Prize.

For the sake of clarity, this Promotion is not open to Non-Resident Indians (NRIs), Overseas Citizens of India (OCIs) and Persons of Indian Origin (PIOs).
Eligible Persons participating or seeking to participate in the Promotion shall individually be referred to as “Participant” and collectively as “Participants”.
If any Eligible Person has listed his/her phone numbers on the National Do Not Call Registry (“NDNC Registry”), he/she shall de-register from the NDNC Registry prior to participating in the Promotion, till the completion of the Promotion (including availing of the Prize (if applicable) under the Promotion). Such persons agree not to make any claim or raise any complaint whatsoever against CCIPL or IA in this respect. 6. How to enter the Promotion

To enter the Promotion, Participants must purchase the PET bottle of Maaza of net quantity 600 ml/1.2L/1.5L (“Promotion Product”) and find the (12) digit Maaza Code visible through the transparent window on the label, once the bottle is empty.

7. Participating in the Promotion

Participants wishing to enter the Promotion and play the Maaza Game can either do so by using the Maaza Code or exercising their chance of Free Game in accordance with the Terms.
MAAZA GAME – CONSTRUCT

  1. On successful completion of Step 1, Step 2, and Step 3 under the Terms, the Participant can choose to click Play Game tab and thereby shall be redirected to the game screen.
  2. The screen displays a variety of mangoes falling downwards. The mangoes shall be in two colours golden and green. The Participant is supposed to avoid green mangoes and squeeze the golden mangoes, using the tap gesture, to progress in the game and earn points.
  3. Game Over Criteria is as following:
    • An attempt of the game will end, if and when, the Participant misses a total of 5 golden mangoes over the course of an attempt or the Participant chooses to leave the game play in the middle of the game.
    • In case the Participant chooses to leave the game in the middle, no points earned in that attempt shall be added to the Leaderboard and taken into consideration for the purpose of Prize.
  4. Every 30 seconds, the game will pause to display one (1) multiple choice question related to brand Maaza and the Grand Prize (“MCQ”). The Participant answering the MCQ correctly will earn bonus points.

    It is hereby clarified that MCQ will be displayed in Free Game as well as in the Maaza Game played with the Maaza Code. However, no MCQ shall be displayed in Practice Game.

  5. The Participant shall be given 10 seconds to answer each MCQ.
  6. The faster the Participant chooses the correct answer, the higher will be his/her bonus score.
  7. Example: If there are 4.9 seconds remaining in the stopwatch when the Participant chooses the correct answer, the added bonus score is 4.9 X 100 = 490 for that round of MCQ.
  8. If the Participant answers incorrectly or does not choose an answer in 10 seconds, there is no bonus score for that round of MCQ and the game continues.
  9. The speed of the falling mangoes will increase after each attempt to answer the MCQ.
  10. If the Participant answers a total of 30 MCQs consecutively in one attempt of the Maaza Game, no more MCQ’s will be displayed and the game shall continue endlessly till one of the ‘Game Over Criteria’ is satisfied.
  11. The Maaza Game comes to an end soon as the Participant misses a total of 5 golden mangoes.
  12. Scoring Mechanism is as following:
  13. Every golden mango gives the Participant +50 points.
  14. Every green mango gives the Participant   -20 points.
  15. Minimum possible score is 0. There cannot be any negative scores.
  16. The scores of multiple games played by the Participant are not added together for the purpose of determination of the rank under the Maaza Game. The best score of the Participant in a week is counted and shown on the Leaderboard.
  17. The Participants will be ranked for the purpose of the Prize, only on the basis of their weekly best score.
  18. The Participant must ensure that no golden mangoes are missed.
  19. Digital Coins and Bonus Coins:
  20. Apart from the Free Game, the Participant can have his/her score added to the Leaderboard by playing the Maaza Game either through the Digital Coin or Bonus Coin.
  21. Digital Coins can be earned by using the Maaza Code, visible through the transparent window on the label of the Promotion Products, once the bottle is empty.
  22. The following number of Digital Coins can be earned through various net quantities of the Promotion Product:
      • 600 ml  :  1 Digital Coin
      • 1.2 L      :  2 Digital Coins
      • 1.5 L      :  3 Digital Coins
  23. Count of Digital Coins represent the number of times the Participant can play the Maaza Game through one Maaza Code.
  24. The score created using a Digital Coin, can be shared by the Participant on Social Media Accounts for another opportunity to play the Maaza Game by earning one bonus coin. (“Bonus Coin”).

    It is clarified that, the score created from using the Bonus Coin can be shared by the Participant on the Social Media Accounts, however he/she shall not be eligible to earn another Bonus Coin.

  25. Each time the Participant plays the Maaza Game using a Digital Coin, the ‘share’ button will be made available.
  26. Bonus Coin enables the Participant to play the Maaza Game again on the same Maaza Code.
  27. The Bonus Coin earned from sharing the score on Social Media Accounts, expires in the same game week it is earned in i.e. a Bonus Coin earned in week 1, will become null and void in week 2.
  28. The game comes to an end when the Participant misses a total of 5 golden mangoes in one attempt of the Maaza Game.

Entry by proxy is not permitted. Participants can only enter in their own name.

Please note that 1 (One) Maaza Code can be used only once for the purpose of participation and will be blocked for all subsequent entries, whether from the same or a different number. Participants may be permitted to participate using the same mobile number, however, they will be required to use an unused Maaza Code.

8. Prizes and Winners

Each week under the Promotion, top 100 ranked Participants in the weekly Leader board shall be gratified. (“Eligible Claimants”)
The gratification is as follows:
a. Rank 1: Grand Prize and Maaza Gift Hamper
b. Rank 2 to 100: Maaza Gift Hamper
It is hereby clarified that the Participants will be ranked for the purpose of the Prize, only on the basis of their weekly best score.
Terms for the Grand Prize:

  • CCIPL shall cover the following expenses and reserves the right to exercise discretion in this regard and the decision of CCIPL shall be final and binding:
  • One (1) ticket to watch the Super Singer Finale Live;
  • Return airfare/2nd AC Train Fare/Bus Fare within Tamil Nadu by the best possible route (depending upon the base location of the winner);
  • Hotel accommodation on twin sharing basis (1 night);
  • 3 meals per day excluding alcohol

It is hereby clarified that the Participant may participate in the Promotion multiple times in accordance with the Terms, but he/she shall be eligible to win the Prize only once under the Promotion.

CCIPL shall not be responsible for any other expenses other than herein specified. Any additional cost shall be borne by the winner. The winners agree that no claims, correspondence or complaints shall be raised against CCIPL or its agents in this regard.

9. Selecting and contacting Eligible Winners

  1. The Participants will be eligible to receive the Prize subject to the Terms detailed herein.
  2. The Participants acknowledge not to raise any claim or complaint against CCIPL and/or IA for their inability to participate in the Promotion due to technical failure in the game website, non-receipt of OTP or any other causes beyond the control of CCIPL or IA.
  3. In case of a tie, the earliest entry during that week will be considered as a better rank.
  4. Each Eligible Claimant under the Promotion shall be contacted by the Travel Agency within ( 7 ) business days of the selection, to obtain confirmation of his/her details.
  5. In the event the Eligible Claimant’s number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach him/her on that day and/or the next day. If even on the third attempt, the Eligible Claimant does not attend the call, or is unreachable, his/her participation in the Promotion comes to an end and the Eligible Claimant’s entry stands canceled and he/she becomes ineligible to receive the prize.
  6. In the event the Eligible Claimant attends the call on either the second or third attempt, the following procedure shall apply:
    • He/she shall be requested to submit the documents namely (“DOCUMENTS”):
      • Copy of his/her Address proof (Electricity Bill or Mobile Bill)
      • Copy of his/her Identity Proof.
    • The Eligible Claimant shall be required to send the Documents by registered post with Acknowledgement Due to the address provided by the Travel Agency or by courier so as to reach within seven (7) days of the call made by the Travel Agency to the Eligible Claimant.
    • If the Documents are not received within the time as stipulated above, then the Eligible Claimant shall lose his/her claim to the Prize.
  7. Upon receipt of the Documents, the Travel Agency shall observe if they are in order and valid, if valid and in order, then such Eligible Claimant shall be confirmed as the Winner for that week.
  8. No Prize under the Promotion shall be awarded if the information presented by the Participant(s) at the time of entering the Promotion is not factually correct.
  9. The cost and expenses of postage shall be borne by the Eligible Claimant himself. CCIPL or the Travel Agency shall not be responsible for any accident or mishap or loss of Documents by the Eligible Claimant in transit. The responsibility of ensuring that Documents reach the address in accordance with the Terms, lies solely with the Eligible Claimant.
  10. No justification/explanation for non-receipt of the Documents or any missing Documents shall be accepted.
  11. In the event of death of the Winner, no claim from the nominee or his/her legal heirs of the Winner shall be entertained for receiving the Prize.
  12. Thereafter the Maaza Gift Hamper shall be delivered by the Travel Agency on the address provided by such Winner within (14) working days after the details have been confirmed by the Travel Agency under the Terms.

    It is hereby clarified that the Winner shall be given the Grand Prize at the venue after he/she reaches the event.

  13. Post dispatching the Maaza Gift Hamper, the tracking details shall be shared with the Winner via SMS or Email.
  14. Once the Maaza Gift Hamper is dispatched from the Travel Agency’s office, it shall not be liable for any in transit theft/damages to it.
  15. Any complaints regarding the non-delivery of the Maaza Gift Hamper should be made within seven (7) days from the time of dispatch (intimated through Email/SMS) of the Maaza Gift Hamper by the Travel Agency. After seven (7) days of intimation of dispatch, CCIPL/the Travel Agency shall not entertain requests pertaining to non-delivery of the Prize.
  16. As a practice, courier companies try to deliver the product two (2) times to a customer if at the first instance courier company couldn’t reach the customer for various of reasons such as (not limiting to) not at home, phone switched off, change of delivery address, wrong address etc. If the Maaza Gift Hamper is returned in such cases, CCIPL / the Travel Agency shall not be liable to dispatch the Prize again.
  17. Prize once delivered cannot be replaced under any circumstances.
  18. Once the Travel Agency gets an intimation from the courier company regarding delivery of the Maaza Gift Hamper, a confirmation call shall be made to the Winner to confirm the same. Post this, an SMS or Email shall also be sent to the Winner stating that the Travel Agency has acknowledged the receipt of Prize by the Winner.

It is to be noted that in the event the Winner does not take the Prize in the time and manner stipulated, then the Prize shall be forfeited by the Winner and cash shall not be awarded in lieu of the Prize. Prizes must be taken as offered and cannot be varied.

10. Conditions relating to the Prize

CCIPL shall not be held responsible for any deficiency, defect, inadequacy or irregularity in the Prize(s). The winner(s) may not exchange or assign the Prizes, and shall not be entitled to any compensation whether in cash or kind from CCIPL or IA.

No portion of the Prizes offered under the Promotion is redeemable for cash. The Prizes are also not refundable or transferable.

No Prize will be awarded if the information presented by the Participant(s) at the time of entering the Promotion, or at any subsequent stage is factually incorrect.
Travel Conditions for Grand Prize:

  • It will be subject to the inclusions and exclusions mentioned in Clause 8 above.
  • The Winner will be intimated of the date, place of departure and other requisite details of the trip sufficiently in advance in order to enable him/her to make all arrangements for the trip (if required).
  • If the Winner, for any reason whatsoever, is unable to board the flight/train/bus as the case may be, from place of departure on a designated date, such Winner’s Prize shall stand forfeited. If the Winner fails to board the return flight/train/bus as the case may be, to the place of arrival on a designated date, the Winner will be required to return at his/her cost and neither CCIPL, Travel Agency nor IA shall be liable for any claims, damages or liabilities arising therefrom.
  • Flight/train/bus schedules are subject to change without notice. All travel is subject to availability of tickets.
  • Winner is responsible for any additional spending (other than those included as specified in clause 8 above) and any other ancillary costs, including but not limited to any excess travel luggage and payment in respect of any damage to property or person caused by the Winner.

11. Publicity

The Participants undertake and irrevocably and unconditionally permit CCIPL to cover the Promotion through various media including newspapers, radio, television including news and other channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur whatsoever to such coverage or in this regard. Further, the Participants also understand and agree that their responses may be publicised as part of this Promotion.

The Winners must, at the request of CCIPL, participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge, and they consent to CCIPL using their name and image in all promotional materials.

12. Intellectual Property

All right, title and interest, including but not limited to the Intellectual Property Rights, in the promotional material(s), and in any and all responses received, or other materials created during or for the Promotion, or during the trip as a part of the Promotion or otherwise, shall vest solely and exclusively with CCIPL at all times. CCIPL or any person or entity permitted by CCIPL in this regard shall be entitled to use any information in connection with the entry in any media for future promotional, marketing, publicity and any other purpose, without any permission and or payment to the Participant.

All material submitted in connection with the Promotion (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to CCIPL upon submission and become the property of CCIPL exclusively. CCIPL may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of CCIPL.

13. General Conditions

  1. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering this Promotion the Participant warrants that all information provided by him/her regarding his/her name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.
  2. CCIPL may, at any time, verify or authorize verification of the Participant’s entry (including such Participant’s identity, age, place of residence and affiliations) and disqualify any Participant (at any stage of the Promotion) if it is found that such Participant has submitted an entry or any Documents that is inconsistent with these Terms.
  3. CCIPL may, disqualify any Participant if such Participant engages in or it is found that such Participant has engaged in any illegal, unlawful or improper conduct (with regard to the Promotion or otherwise).
  4. The decision of IA as regards the selection of valid entries, Prizes, and Winners is subject only to CCIPL’s approval. No correspondence or any other claims whatsoever, in this regard will be entertained. The Prizes cannot be exchanged and are not transferable or refundable. Further, the Prizes are not redeemable for cash or any monetary benefits in kind.
  5. CCIPL reserves the right at its sole discretion to cancel, terminate, postpone, modify or suspend the Promotion in whole or in part at any time including if, for any reason, the Promotion is not capable of running as planned, including due to any technical failure or any other causes beyond the control of CCIPL or IA and will not be liable for any consequential losses/damages. All Winners and/or Participants agree that no claims or complaints may be raised against CCIPL, IA or any of their affiliates, representatives, associates etc. in this respect. Any decision of CCIPL in this regard and in general with respect to this Promotion and the Terms thereto shall be final, binding and non-contestable.
  6. CCIPL further reserves the right to modify or cancel the Prizes offered under this Promotion, at its sole and absolute discretion. The Winners and/or the Participants agree that no claims or complaints whatsoever may be raised against CCIPL, IA or any of their affiliates, representatives, associates etc. in this respect.
  7. Participants shall follow all directions/rules and regulations (whether communicated in written form or verbally) framed by CCIPL or IA at all times in connection with the Promotion. Any deviation or objection by any Participant(s) may result in their disqualification from the Promotion.
  8. The Participant(s) hereby undertake to provide and/or execute any Documents as may be deemed necessary by CCIPL to effectively carry out his/her obligations under the Promotion and/or its Terms.
  9. Nothing contained herein amounts to a commitment or representation by CCIPL to conduct further promotions.
  10. The decision of CCIPL shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms shall be deemed to constitute a partnership or agency between any Participant and CCIPL and the Participant shall not have the authority to bind CCIPL in any manner whatsoever.
  11. CCIPL, IA and other agents of CCIPL shall not be liable to perform any of their respective obligations under the Promotion or in respect of the Prizes where they are unable to do so as a result of circumstances beyond their control in the nature of fire, explosions, natural calamities, state emergency, riots, government restrictions or any other Force Majeure condition, etc., and shall not be liable to compensate the Winners or the Participants in these circumstances.
  12. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of CCIPL or IA.
  13. Winners and Participants undertake not to, at any time, disclose, reveal, communicate or otherwise make public any information relating to CCIPL, their respective business, personnel, servants, agents or officers to anyone.
  14. CCIPL accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, communication, Documents, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. CCIPL shall not liable for any consequences of user error including (without limitation) costs incurred. In addition, if the Documents and other requirements are lost, damaged, defaced, tainted, illegible or corrupted on account of the fault or deficiency of the Postal Services, CCIPL shall not be under an obligation to entertain such Documents and CCIPL may at its sole discretion choose to disentitle the Winner from his/her Prize. CCIPL is not obliged to inform such a Winner of the disentitlement; however, it may choose to bring the same to the notice of the Winner through any of the means available to it.
  15. CCIPL shall not be responsible if the Super Singer Finale is cancelled or rescheduled for any reason whatsoever and CCIPL shall not be liable to compensate the Winners or the Participants in these circumstances.
  16. If a Participant is dissatisfied with the Promotion or the Promotion Terms, his/her sole and exclusive remedy is to not participate in the Promotion.
  17. The general terms and conditions and privacy policy on the Promotion Website shall be applicable in addition to these Terms.
  18. Neither CCIPL or IA shall be required to publish or disclose any personal details about the Winners of the Promotion (excluding the names of the Winners which may be published on the Promotion Website), including but not limited to their telephone number, address, etc., as such disclosure shall amount to violation of the privacy rights of winners.
  19. Please note that neither CCIPL, IA or any of its affiliates, representatives etc. shall be responsible for any disruption, disturbance or disconnection in the phone line and any undelivered, and/or incomplete SMS and all disputes, complaints, claims shall be raised with the Telecom Service Provider only.
  20. These Terms may be altered by CCIPL at its sole and absolute discretion and without any notice to the Winners and/or Participants.

14. Release and Limitations of Liability

  1. By entering the Promotion, the Participants hereby release from and agree to indemnify CCIPL, IA and/ or any of their respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the Prize or participation in the Promotion including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.
  2. CCIPL and IA accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of themselves or third parties in relation to the Prizes. CCIPL, IA and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for any late, lost, misrouted, garbled or distorted or damaged transmissions on the website or malfunctioning of the Maaza Game.
  3. The Participant(s) shall be solely responsible for any consequences which may arise due to their participation in the Promotion by conducting an illegal act. Participant(s) also undertakes to indemnify CCIPL and/or IA and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by CCIPL or IA on account of such act on the part of the Participant. Participant(s) hereby agree to indemnify, defend and hold harmless CCIPL in case of any loss or liability (including but not limited to liabilities, judgments, damages, losses, fines and penalties, claims, costs and expenses such as attorneys’ fees and expenses) or any other loss associated with, arising out of or incidental to their ineligibility to participate, any untoward, rash or negligent act on their part, or non-compliance or alleged non-compliance with these Terms, any other rules, regulations, directives (whether written or verbal) issued by CCIPL or IA from time to time, during the Promotion.
  4. To the fullest extent permitted by law, in no event will CCIPL or IA or any of their officers, servants, employees, representatives and/or agents (including without limitation, any third party service providers that CCIPL or IA may engage for purposes of the Promotion), be liable for any loss or damages (including, without limitation loss of income, profits or goodwill, indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with the Promotion and/or the Promotion prizes, even if CCIPL or IA has been advised of the possibility of such damages in advance, and all such damages are expressly excluded. The Participant shall indemnify, defend, and hold CCIPL and IA harmless in the event of there being any third party/entity/organization claims arising from or related to his/her participation in the Promotion. In no event shall CCIPL and IA be liable to any Participant for acts or omissions arising out of or related to the Promotion or his/her participation in the Promotion.
  5. In consideration of CCIPL allowing the Participant(s) to take part in the Promotion, to the maximum extent permitted by law, the Participant(s) waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against CCIPL, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Promotion or related to the Promotion or the Prizes of the Promotion.

15. Dispute

  1. The courts of competent jurisdiction at Gurgaon shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Promotion.
  2. Participation in the Promotion is unauthorized in any jurisdiction that does not give effect to all provisions of these Terms, including without limitation, this clause.
  3. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms, or the rights and obligations of the Participants and/or CCIPL and/or partners of this Promotion, shall be governed and construed in accordance with the laws of the Republic of India.
