#ThumsUp4India - Terms & Conditions

By participating in this Contest, each Participant is indicating his/her agreement to be bound by the following Terms and Conditions:

  1. The ‘#ThumsUp4India’ Contest/Promotion organized by Coca-Cola India Private Limited (“CCIPL”) comprises of user participation via posting of video, picture and text messages on their profiles and will be valid from 19th July 2021 to 24th July 2021. (“Term”)
  2. The Contest is valid only for individuals over 13 years of age, residing in India (“Contestant”) except the state of Tamil Nadu and Kerala. However, the winners from age of 13 to 18 winning the Contest shall not be entitled to the Prize unless, he/she is represented by the parent/guardian, and the parent/guardian completes all necessary formalities on his/her behalf.
  3. There shall be 250 Winners in total (Max). The number of winners can be lesser depending on the number of entries received from this contest. (“Winners”)
  4. Individuals participating in the Contest shall get a chance to win the following Prize in accordance with clause 7 below:
    • Merchandise gift hamper from Thums Up which will include Sipper - 1, Fridge Magnet - 1, TShirt – 1XL Size (a “Prize”)
  5. A Contestant is eligible to win the Prize only once under the Contest.
  6. To participate in the Contest, the Contestant has to:
    • Send his/her wishes to the Indian athletes for the Olympic Games Tokyo 2020 in the form of videos, pictures and comments on the contest announcement post on Facebook or Twitter or Instagram using #ThumsUp4India and tagging @thumsupofficial (“Entry”)
    • Entries received ONLY in English and Hindi language will stand valid for the contest.
    • The Contestant must use #ThumsUp4India, #PalatDe, #Tokyo2020 in the comment to make it a valid entry.
    • The Entry must be made public.
  7. Contest Mechanism and Selection Criteria:
    1. The Winners’ selection would be done by CCIPL and the decision would be final.
    2. Thums Up shall announce Winners for each day of the Contest Term, within 48 hours of the conclusion of each Contest day. Winners will be selected through computerized random selection from the pool of most engaging Entries, in accordance with these Terms & Conditions.
    3. Entries that fulfil all the guidelines mentioned herein shall be considered as valid and eligible to win.
    4. Each Winner shall be required to send a direct message to the respective Social Media handle of Thums Up within 72 hours of announcement of the Winner(s) and each Winner must respond with the required details (valid ID proof and/or proof of address, contact number and email ID) within 72 hours to claim his/her Prize. In case the Winner does not communicate and/or fails to provide required details within these 72 hours of the result declaration, he/she will not be eligible to win the Prize and the Prize shall be transferred to the next eligible winner.
    5. No exchange of the Prize will be entertained.
    6. One (1) participant is eligible to win only one (1) Prize, irrespective of the number of Entries he/she makes.
    7. The Prizes shall be delivered to the Winners via courier within 90 days of the conclusion of the Contest Term.
    8. CCIPL shall not be liable for any delay or non-receipt of prizes/awards by the Winner due to any act or omission of third-party courier partners and/or due to incomplete or incorrect details shared by the Winner.
    9. Prizes are offered on ‘NO EXCHANGE, NO REFUND’ and ‘Non-transferable’ basis.
  8. The CCIPL social media cell will be monitoring all the content and any content that is not as per IOC Guidelines will not be entertained.
  9. It is expressly clarified that any Entry which falls under any of the following criteria will not be considered a valid Entry under these Terms and will be immediately disqualified from being eligible for the Prize:
    • Image/video/text containing objectionable or obscene content (such as pornography, nude pictures, objectionable gestures, etc.)
    • Image/video/text containing offensive or inflammatory content such as swear words or content that explicitly or implicitly demonstrate discrimination based on colour, community, caste, creed, nationality etc.
    • Image/video/text that contain any content that maligns The Coca-Cola Company, CCIPL or any of the beverages of the brands owned by The Coca-Cola Company
    • Image/video/text that contain images or references to competitors of CCIPL in the background
    • Image/video/text that contain politically themed images such as photographs of political leaders, party signs, symbols or logos
    • Comments accompanying the image/video that contain any of the above content
    • Use of hashtags other than the relevant approved Contest related hashtag
    • Any comment or image/video that contain content which violate copyright laws or the intellectual property rights of a third party

    CCIPL reserves the right to amend, modify or cancel the Contest without any prior notice.

  10. CCIPL assumes no liability or responsibility for:
    • Any errors, omissions or inaccuracies of content or submissions.
    • Personal injury or property damage of any nature resulting from Contestant’s access to, Contestant’s exposure to or Contestant’s participation in the Contest.
  11. At CCIPL’s request, the Winners agree to participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge, and they consent to the CCIPL using their name, likeness, image and/or voice in the event they are winners (including photograph, film and/or recording of the same) in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this Contest and promoting any products manufactured, distributed, marketed and/or supplied under the trademarks owned by The Coca-Cola Company.
  12. No cash payment will be made in lieu of the Prize.
  13. The Prize is personal to the Winners and is not transferrable and cannot be sold under any circumstances.
  14. CCIPL shall not be responsible for any loss, injury or any other liability arising out of the Contest or due to participation by any person in the Contest.
  15. CCIPL shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss with respect to the Prize.
  16. Content of Entries and all related rights shall remain the exclusive property of CCIPL.
  17. CCIPL shall not be held responsible for any deficiency, defect, inadequacy or irregularity in the Prize(s).
  18. No portion of the Prizes offered under the Contest is redeemable for cash. The Prizes are also not refundable or transferable.
  19. No Prize will be awarded if the information presented by the Participant(s) at the time of entering the Promotion, or at any subsequent stage is factually incorrect.
  20. The Prizes shall be provided to the Winners on an “as-is basis” and without any warranty or guarantee concerning the quality, suitability or comfort, and CCIPL and/or its associates, affiliates and/ or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency and/or defect of any product/service and/or the Prize or for any kind of consequential damages/ loss, in any manner whatsoever. The guarantee and warranty of the Prizes shall be transferred to the Winners as received from the Manufacturer / Distributor.
  21. If any Participant has any grievance with respect to the Prize, he/she may directly contact the manufacturer.
  22. The Winner(s) may not exchange or assign the Prizes and shall not be entitled to any compensation whether in cash or kind from CCIPL.
  23. All disputes relating to this Contest shall be subject to the exclusive jurisdiction of Courts at Gurgaon only.
  24. CCIPL's decision shall be final in all respect.
